Please read these Terms and Conditions of Service (“Terms”) carefully before using the website located at wobblemonkey.com (the “Website”) and any mobile applications provided by us, including English Grammar Star, English Verb Smash, English Grammar Smash, Match Up Learn English Words, and Learn and Spell English Words (collectively, the “Apps” or “Services”).

These Terms constitute a legally binding agreement between you and Wobble Monkey Studios Ltd (“Wobble Monkey”, “we”, “us”, or “our”).

2. Product Architecture & Age Eligibility

Our product catalog features a mixed-audience architecture. The eligibility rules for our Services depend strictly on the type of application and features you access:

• Unauthenticated Educational Products & Guest Mode (All Ages): Certain applications within our portfolio, including Learn and Spell English Words and Match-Up Learn English Words, or the local guest workspace inside our authenticated apps, are designed for students of all ages, including children under the age of 13. Users under 13 may view global competitive rankings, but they will be restricted to a locally generated, non-editable random username (e.g., GuestPlayer123) to preserve total anonymity. Underaged users are completely prohibited from inputting personal identifiers or custom names into our network systems.
• Authenticated & Custom Social Features (Ages 13+ Only): Features involving remote cloud profile synchronization, personalized accounts via third parties (Apple/Google Sign-In), and custom, self-selected leaderboard display names are strictly restricted to individuals aged 13 or older.

If you are under the age of 13, you are strictly prohibited from attempting to register an account or log in via Apple or Google. If we discover we have inadvertently collected cloud profile data or custom name configurations from a child under 13, we will delete that profile immediately.

3. Account Registration, Safety, & Leaderboards

To access certain synchronized progress metrics and competitive structures, users over the age of 13 must authenticate using our third-party sign-in mechanisms.

• Account Security: You are responsible for safeguarding your login credentials and for all activities that occur under your account.
• Leaderboard Data: If you are signed into an account, your chosen public Display Name and learning metrics will be visible to other global users on public leaderboards. You are solely responsible for ensuring your chosen Display Name does not reveal your real-world identity. If you use the Apps without an account as a guest, your metrics remain local to your physical device, anonymous, and will not appear on public leaderboards.

4. Payments, Subscriptions, & In-App Purchases

Wobble Monkey offers paid apps, optional in-app purchases (IAPs), and plans to offer recurring subscription models in the future.

• App Store Processing: All financial transactions, billing, payments, and refunds are processed securely through the third-party application store from which you downloaded the App (e.g., the Apple App Store or Google Play Store). You agree that such transactions are subject to those respective platform terms.
• Subscriptions: If you opt into a future subscription tier, you will be billed in advance on a recurring, periodic basis. You can manage or cancel your subscription at any time directly through your Apple or Google account subscription settings. All fees are non-refundable except as required by law or platform policies.

5. Third-Party Advertising (AdMob)

Our free-to-use application tiers display third-party advertisements served via Google AdMob. By using the Services, you acknowledge that these third-party systems may process device identifiers or basic cookies to serve ads. We do not knowingly serve targeted behavioral advertisements to users who have identified themselves as minors through our age gate, or within applications explicitly designated for younger learners (such as Learn and Spell English Words and Match-Up Learn English Words).

6. International Data Transfers (UK/EU to USA)

Wobble Monkey Studios Ltd is based in the United Kingdom. However, data collected via the Website and account-driven Apps is securely transferred to and stored on servers located in the United States of America. By using the authenticated Services and submitting profile data, you acknowledge this international transfer. We implement strict safeguards, including Standard Contractual Clauses (SCCs) and adherence to valid adequacy frameworks (such as the Data Privacy Framework), to ensure your data receives an equivalent level of protection as mandated by the UK GDPR and EU GDPR.

7. Intellectual Property Rights

All content, features, and functionality within the Website and Apps—including but not limited to lessons, texts, graphics, grammar structures, game mechanics, software, audio clips, logos, and layouts—are the exclusive intellectual property of Wobble Monkey Studios Ltd and are protected by UK and international copyright, trademark, and intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services strictly for personal, non-commercial educational use.

8. Limitation of Liability & "As Is" Disclaimer

The Website, Apps, lessons, and activities are provided to you on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, Wobble Monkey Studios Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, resulting from your use of or inability to use the Services. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be lawfully excluded under English law.

9. Governing Law & Jurisdiction

These Terms, their subject matter, and their formation are governed exclusively by the laws of England and Wales. You and Wobble Monkey Studios Ltd both agree that the courts of England and Wales will have exclusive jurisdiction over any disputes arising out of or in connection with these Terms or the use of our Services.
